These Terms of Service ("Terms") govern your access to and use of the DMV Master website at dmvmaster.org and our mobile applications (together, the "Services"). Please read them carefully. By using the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
⚠ Important: DMV Master is an independent educational publisher. We are NOT affiliated with, endorsed by, or sponsored by any Department of Motor Vehicles, licensing authority, or government agency. Our practice tests are study aids, not official tests, and we cannot guarantee any particular outcome on a real DMV exam.
1. Acceptance of These Terms
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect information from children under 13; see our Privacy Policy for details.
3. Description of the Services
DMV Master provides educational materials intended to help U.S. drivers prepare for their state's written knowledge test, including:
- Practice questions with answers and explanations
- State-by-state summaries of test requirements, passing scores, and laws
- Sample tests and mock exams in our mobile applications
- Study resources and content organized by topic
3.1 Freemium Model
Our mobile applications are offered under a freemium model. A meaningful portion of our content and features is available free of charge, including a selection of practice questions, basic study tools, and state-specific information. Additional features are available by purchasing a paid subscription ("Premium" or "Pro"), such as:
- Access to the full question bank for your state
- Unlimited mock exams that simulate the real DMV test
- Advanced progress tracking and personalized study recommendations
- Ad-free experience
- Offline mode
- Priority customer support
The exact list of free and paid features may change over time. The most current list is displayed inside the mobile applications. We may add, modify, or remove features from either tier at our discretion.
4. Not an Official Source — Important Disclaimers
4.1 No Government Affiliation
DMV Master is a private, independent publisher. We are not affiliated with, endorsed by, authorized by, or in any way officially connected to the U.S. Department of Motor Vehicles, any state DMV, any state Department of Public Safety, or any other governmental entity.
4.2 No Guarantee of Passing
Our practice tests are intended as study aids only. We do not guarantee that using the Services will result in you passing your real DMV written test. Your results depend on many factors, including your study effort, reading comprehension, the specific questions on the real test (which may change), and your state's current testing standards.
4.3 Always Verify With Official Sources
Laws, road rules, test formats, passing scores, and fees change over time and vary by state. While we work hard to keep our content accurate and up-to-date, you are responsible for verifying current rules and requirements with the official source — typically your state DMV website or official driver handbook — before taking any real DMV exam or making driving decisions based on our content.
4.4 Not Legal or Driving Advice
Content on the Services is for informational and educational purposes only. It is not legal advice, driving instruction, or a substitute for the official driver handbook or a certified driving instructor. If you need specific legal or safety advice, consult a qualified professional.
5. Subscriptions, Billing, and Cancellation
5.1 Subscription Plans
Paid subscriptions to DMV Master Premium (also marketed as "Pro") may be offered on a monthly, quarterly, annual, or one-time-purchase basis. The specific plans, prices, features, and billing cycles available to you are shown in the mobile applications at the time of purchase and may vary by country, platform, and promotional offers.
5.2 Payments Are Processed by Apple or Google
All subscriptions and in-app purchases are sold through the Apple App Store (for iOS users) or the Google Play Store (for Android users). We do not collect or process your payment information. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Apple and Google are responsible for all billing, receipts, refund authorization, and taxes.
5.3 Auto-Renewal
Unless otherwise stated, all subscriptions automatically renew at the end of each billing period (monthly, quarterly, or annually, depending on your plan) until you cancel. Specifically:
- Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of renewal will be identified in the App Store or Google Play settings.
- Subscriptions may be managed by you, and auto-renewal may be turned off by going to your Account Settings in the App Store or Google Play after the purchase.
5.4 Free Trials and Promotional Offers
From time to time, we may offer a free trial or introductory discount. If you begin a free trial:
- You will not be charged during the trial period, provided you cancel before the trial ends
- If you do not cancel before the end of the trial, you will be automatically charged for the regular subscription price
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a paid subscription, where applicable
- Only one free trial per user, per app, per Apple ID or Google Play account is permitted unless otherwise stated
5.5 How to Cancel Your Subscription
You can cancel your subscription at any time — before cancellation becomes effective at the end of your current billing period. Cancelling stops future renewals but does not provide a refund for the current period (see Section 5.6).
On iOS (iPhone/iPad):
- Open the Settings app → tap your name at the top → Subscriptions
- Tap your DMV Master subscription → Cancel Subscription
- Or: open the App Store → your profile picture → Subscriptions → select DMV Master → Cancel
On Android:
- Open the Google Play Store → tap your profile picture → Payments & subscriptions → Subscriptions
- Tap DMV Master → Cancel subscription
Deleting the app alone does not cancel your subscription. You must cancel through the App Store or Google Play.
5.6 Refunds
Because subscriptions are billed and delivered through Apple or Google, refund requests are governed by their respective policies:
- Apple App Store refunds: request at reportaproblem.apple.com
- Google Play refunds: request within 48 hours via the Google Play Store, or contact Google Play Support for older purchases
We do not directly issue refunds for purchases made through the App Store or Google Play. We may, at our sole discretion, provide a prorated credit or goodwill remedy in exceptional circumstances, but we are not obligated to do so. Where you have a statutory right to a refund under applicable consumer law (for example, the 14-day right of withdrawal in the European Union for digital services, subject to the exceptions that apply to immediately-accessible digital content), we will honor that right in accordance with the law.
5.7 Price Changes
We may change subscription prices from time to time. If we do, we will provide you with reasonable advance notice before the change takes effect on your subscription. Apple and Google may also require you to affirmatively consent to a price increase before continuing your subscription. If you do not consent, your subscription will not renew at the new price.
5.8 Taxes
Subscription prices may or may not include applicable taxes, depending on your country, state, and the policies of Apple or Google. Apple and Google are responsible for calculating and remitting applicable taxes on your behalf.
5.9 Termination of Paid Access
If your subscription is cancelled (by you or by Apple/Google due to failed payment or other reasons) or expires, you will lose access to premium features at the end of the billing period for which you last paid. Your free-tier access will continue.
6. Accounts (If Applicable)
Some features — particularly in our mobile apps — may require you to create an account. If you create an account, you agree to:
- Provide accurate and current information
- Keep your password confidential and secure
- Notify us promptly of any unauthorized access or security breach
- Be responsible for all activity that occurs under your account
We may suspend or terminate accounts that violate these Terms.
7. Acceptable Use
You agree not to:
- Copy, scrape, harvest, or systematically extract content from the Services for commercial use or to build a competing product
- Reverse-engineer, decompile, or attempt to derive the source code of our applications
- Use the Services to develop a competitive DMV prep product or service
- Introduce malware, viruses, or any malicious code
- Attempt to gain unauthorized access to our systems, other users' accounts, or any connected systems
- Interfere with or disrupt the Services, servers, or networks
- Use automated means (bots, crawlers) to access the Services, except for legitimate search engine indexing
- Misrepresent your identity or affiliation with any person or entity
- Use the Services for any unlawful, harmful, or fraudulent purpose
- Violate any applicable law, regulation, or third-party right
You may view, use, and share our content for your personal, non-commercial study. Any other use — including republishing substantial portions on another website or app, whether for free or commercial purposes — requires our prior written permission.
8. Intellectual Property
8.1 Our Content
The Services and all related content — including text, practice questions, explanations, images (except those derived from public-domain government handbooks), graphics, logos, software, and design — are owned by DMV Master or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
8.2 Public-Domain Source Material
Some of our content is adapted from state DMV driver handbooks, which are public-domain government works. Our original explanations, organization, layout, and curation, however, are proprietary.
8.3 Limited License to You
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial study. No other rights are granted.
8.4 Feedback
If you send us feedback, suggestions, or ideas about the Services, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback without restriction or compensation to you.
9. Third-Party Links and Services
The Services may contain links or references to third-party websites, services, or products (for example, links to state DMV websites, the Apple App Store, or the Google Play Store). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their own terms.
10. Mobile App Stores
If you downloaded our mobile application from the Apple App Store or Google Play Store, these Terms apply in addition to the applicable store's terms. You acknowledge that:
- These Terms are between you and DMV Master, not between you and Apple or Google
- Apple and Google are not responsible for the application, its content, or any support or warranty claims
- Apple and Google are third-party beneficiaries of these Terms with respect to your use of the application
11. Termination
We may suspend or terminate your access to the Services, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time. Upon termination, the sections of these Terms that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.
12. Disclaimers of Warranties
The Services and all content are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, DMV Master disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and uninterrupted availability.
Without limiting the above, we do not warrant that the Services will be error-free, that defects will be corrected, that the Services or servers are free of viruses or harmful components, or that any content is accurate, current, or complete.
13. Limitation of Liability
To the maximum extent permitted by law, in no event shall DMV Master, its owners, employees, affiliates, or licensors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, failed DMV tests, increased insurance rates, or driving-related injuries or damages, arising out of or relating to your use of or inability to use the Services — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for all claims arising out of or relating to the Services shall not exceed one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the event giving rise to liability, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless DMV Master, its owners, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of the Services, or your violation of any law or third-party right.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles.
15.2 Informal Resolution
Before filing a formal claim, you agree to attempt to resolve any dispute informally by contacting us at pass@dmvmaster.org. We will attempt to resolve the dispute in good faith within 60 days.
15.3 Venue
Any unresolved claim or dispute shall be filed exclusively in the state or federal courts located in the State of Florida, United States, and you consent to the personal jurisdiction of such courts.
15.4 Waiver of Class Actions
To the extent permitted by law, you agree that any dispute resolution will be conducted on an individual basis and not in a class, consolidated, or representative action.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If the changes are material, we may provide additional notice (such as by email or a prominent site notice). Your continued use of the Services after an update becomes effective constitutes acceptance of the revised Terms.
17. Miscellaneous
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DMV Master regarding your use of the Services.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- No Waiver. Our failure to enforce any provision shall not be deemed a waiver of that provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may freely assign these Terms.
- Headings. Section headings are for convenience only and have no legal effect.
